One expert believes that the federal Supreme Court would grant the petition to review the SSI case.

A recognized expert in U.S. Supreme Court matters believes that the court will grant the petition to review the Supplemental Security Income (SSI) case.

In one of his writings in the digital magazine on federal Supreme Court matters, John Elwood noted yesterday that Luis Vaello Madero's case "looks like a possible approval" for review.

In his brief article, he highlights that "Vaello Madero is a rare case" because he already "has friend-of-the-court briefs supporting the defendant" submitted at a stage prior to certiorari review.

That is to say, before it is accepted by the Federal Supreme Court, it already has different sectors pronouncing their position in favor of one of the parties.

"Those reports are rarely submitted because statistically they correlate with approvals and can be counterproductive," observed Elwood, who served as assistant U.S. attorney general from 2002 to 2005.

Elwood, who also worked at the federal Department of Justice between 2005 and 2009, also noted that Vaello Madero is one of two cases that were rescheduled by the U.S. Supreme Court.

After being on the agenda last month, it was included among the topics that could be discussed today, Friday, at the first conference of federal Supreme Court justices in 2021.

The petition for review was filed by the U.S. government in an attempt to reverse the decisions of the Federal Court in San Juan and the First Circuit Court of Appeals in Boston, which found it unconstitutional to exclude residents of Puerto Rico from SSI.
